Since January 18 th , 2016 you can submit declaration of temporary or occasional provision of services
electronically through the European professional card. In case of submission of declaration via European professional
card, the declaration is valid for 18 months (in case of sending physical declaration it is only12 months). EPP

The competent authority for recognition qualification of auditor is Czech Chamber of Auditors and the
legislation regulating the recognition and qualification is Act N°169/2004 Coll, on auditors.

Qualification of advocate is regulated by Directive 77/249/EEC of 22 March 1977 to facilitate the effective
exercise by lawyers of freedom to provide services and Directive 98/5/EC of the European Parliament and of the
Council of 16 February 1998 to facilitate practice of the profession of lawyer on a permanent basis in a Member State
other than that in which the qualification was obtained which were followed by Directive 2005/36/EC, on recognition
of professional qualifications.

A profession, professional activity or trade is regulated when there is a legislative regulation giving a condition
under which the profession can be pursued. Without meeting these conditions (qualification, education, good repute
etc..), the professional is not entitled to pursue the profession.

Recognition of a professional qualification is a necessary condition for the practise of a regulated profession if
that qualification has been obtained in another Member State of the European Union, the European Economic Area or
Switzerland.
It focuses on assessing the knowledge and skills of a specific person, with this knowledge and skills being possible
to prove by a document of formal qualification (education and preparation) but also by a document of an actual
performance of the relevant activity or other document. The outcome of the process of professional recognition is a
decision as to whether the person in question has sufficient knowledge and skills to be able to perform the specific
profession or activity.

The European Professional Card (EPC) is an electronic procedure you can use to have your professional qualifications
recognised in another EU country. It is easier and quicker to manage than the traditional qualification recognition
procedures, and it is more transparent: you can keep track of your application on-line and re-use already uploaded
documents to start new applications for different countries.

Title VIII of Act 18/2004 Coll. on recognition of professional qualification introduces the declaration of temporal
or occasional pursuit of regulated profession (i.e.provision of services), which the provider shall submit to the
competent recognition authority. If the declaration is submitted with all necessary documents, the provider is
entitled to provide services in the Czech Republic. The only exception is pursuit of professions that have
consequences for public health and security and at the same time do not fall within the scope of automatic
recognition. In that case the competent authority may check the qualification before the first provision of services
(see art. 7.4 of Directive 2005/36/EC and §36b of Act 18/2004 coll.).

The most common way to recognize professional qualification is the general system of recognition of professional
qualification. There are several professions which are excluded from the general system of recognition. Precisely,
this exception applies to recognition of a profession where the professional experience could be accepted, to
automatic recognition and to recognition of the qualification of an advocate.
Since 18th January 2016 it is possible to apply for recognition of professional qualification via European
Professional Card (see section What is European Professional Card?)
