1. General system of recognition of professional qualification
In this case the applicant has to decide which profession he/she would like to pursue in the Czech Republic. If the profession IS regulated, he/she should find out conditions under which the profession can be pursued in the Database of regulated profession and then they should fill in the form (in the section Documents, contacts and forms). The Application should by accompanied by the ID and documents proving obtaining the professional qualification and proof of fee payment.
The decision on recognition of professional qualification can be
- positive
- negative
- in case of substantial differences the competent authority may impose a compensation measure. The applicant may choose from
- adaptation period (generally no longer that 3 years)
- aptitude test
2. Recognition of professional experience
Professional experience may be recognized when the profession is included in Annex IV of the Directive 2005/36/EC (generally crafts). The process of recognition is different from general system, according to §18 Act 18/2004 Coll. To find out the exact combination of required education and experience so that the qualification is recognized, please see §18 par. 1 of Act 18/2004 Coll.
3. Automatic recognition (Sectoral Professions) and other exceptions
The Professionals in the field of sectoral professions may benefit from the highest level of harmonization of required education and experience preparing for these professions:
- Doctor, dentist, pharmacist (based on Act no. 95/2004 Coll., On conditions for obtaining and recognition of professional qualifications for pursuing the medical professions of doctor, dentist and pharmacist);
- Architect (under Act no. 360/1992 Coll., On the Professional Practice of Certified Architects and on the Professional Practice of Certified Engineers and Technicians in construction);
- A nurse midwife (under Act no. 96/2004 Coll., On the paramedical professions
- Veterinarian (under Act no. 166/1999 Coll., On veterinary care)
Minimal requirements for pursuit of these professions are not based on by internal legislation of member states but on the legislation of the EU. Annex V of the Directive 2005/26/EC lists all study programmes and faculties that are accepted and recognized in all member states. Therefore, if the applicant wishes to exercise any of sectoral professions and possesses a diploma mentioned in Annex V, then his/her qualification can be recognized automatically.
Other exceptions:
- Lawyer
This profession is regulated by Act no. 85/1996 Coll., On advocacy and by the Directive 98/5/EC. A lawyer who is authorized to work in his/her home country, may provide legal services in another member state, but uses the title used in his/her state. Then he/she appears on the list of “European lawyers”. However, if the applicant would like to become a lawyer dealing with Czech law, he/she must undergo three years legal traineeship and pass the bar exam, as well as Czech citizens.
- Auditor
This profession is regulated by Act no. 254/2000 Coll., On auditors and the Directive 2006/43 / EC.
